Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and CinderSpire Studio ("Company," "we," "us," or "our"), governing your use of the Lookify mobile application ("App") and all related services.

By downloading, installing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use the App.

You represent that you are at least 13 years of age (or the minimum age required in your jurisdiction) and have the legal capacity to enter into these Terms. If you are under the age of 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. Description of Service

Lookify is an AI-powered virtual try-on application that allows users to:

• Upload or capture photos (selfies or gallery images)
• Virtually try on different hairstyles, hair colors, makeup styles, and clothing items using artificial intelligence
• View and save AI-generated results to their device
• Browse curated style categories and trends

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

3. User Accounts & Registration

Lookify uses anonymous device-based identification. You are not required to create an account or provide personal information such as your name, email address, or phone number to use the App.

• Device ID: A unique, pseudonymous identifier is assigned to your device for the purposes of credit tracking, rate limiting, and subscription management.
• No Account Recovery: Since identification is device-based, your credits, usage history, and subscription status are tied to your device. If you switch devices, your data may not transfer automatically unless managed through your Apple ID or Google account for subscriptions.
• One Device, One Identity: Each device is treated as a separate user. Sharing or transferring your device identity is not permitted.

4. Subscription Terms

4.1 Plans & Pricing

Lookify offers a free tier with limited credits and a premium subscription ("Lookify Premium") with the following plans:

• Monthly Plan: Billed monthly with a recurring charge
• Yearly Plan: Billed annually at a discounted rate

Current pricing is displayed within the App. Prices may vary by region and are subject to change with prior notice.

4.2 Free Trial

We may offer a free trial period (typically 3 to 7 days) for new subscribers. During the trial:

• You will have access to all premium features at no charge
• The trial begins when you confirm the subscription through the Apple App Store or Google Play Store
• If you do not cancel before the trial period ends, your subscription will automatically convert to a paid subscription, and you will be charged the applicable subscription fee
• Free trial eligibility is determined by the app store and is generally limited to one trial per Apple ID or Google account

4.3 Auto-Renewal

All subscriptions automatically renew at the end of each billing period unless cancelled. By subscribing, you authorize recurring charges to your payment method on file with the applicable app store.

• Your subscription will automatically renew within 24 hours before the end of the current period
• The renewal charge is the same as the original subscription price unless we provide advance notice of a price change
• You can manage and cancel your subscription at any time through your device's app store settings

4.4 Cancellation

You may cancel your subscription at any time. Upon cancellation:

• You will continue to have access to premium features until the end of your current billing period
• No partial refunds will be issued for unused time in the current billing period
• Your account will revert to the free tier when the current period expires
• Any unused premium credits will expire when your subscription ends

4.5 How to Cancel

• iOS: Settings > [Your Name] > Subscriptions > Lookify > Cancel Subscription
• Android: Google Play Store > Profile > Payments & subscriptions > Subscriptions > Lookify > Cancel

4.6 Refunds

All payments are processed by the Apple App Store or Google Play Store. Refund requests must be directed to the respective app store:

• Apple: reportaproblem.apple.com
• Google: Google Play Refund Policy

CinderSpire Studio does not process payments directly and cannot issue refunds. Refund eligibility is determined by the applicable app store's refund policy.

5. Credit System

Lookify uses a credit-based system to manage usage of the AI try-on feature:

5.1 Earning Credits

• Free Tier: Free users receive a limited number of credits daily
• Premium Subscribers: Subscribers receive a monthly credit allocation based on their plan
• Rewarded Ads: Free users may earn additional credits by watching rewarded video advertisements
• Credit Packs: One-time purchase credit packs may be available for additional credits

5.2 Credit Terms

• Credits are non-transferable and cannot be exchanged, sold, or gifted to other users
• Credits have no monetary value and cannot be redeemed for cash
• Subscription credits reset with each billing cycle; unused credits from the previous cycle do not carry over
• Free daily credits reset every 24 hours and do not accumulate
• Credit pack credits are valid for the period specified at the time of purchase
• We reserve the right to modify credit allocations, pricing, and expiration terms with reasonable notice

5.3 Credit Pack Purchases

Credit packs are one-time, non-refundable consumable purchases. Once purchased, credits are added to your balance and are subject to the same terms as subscription credits regarding transferability and monetary value. Refund policies for credit packs are governed by the applicable app store.

6. User Content

6.1 Your Photos

You retain full ownership of the photos you upload to or capture within the App. By using the Service, you grant CinderSpire Studio a limited, non-exclusive, royalty-free, worldwide license to:

• Process your photos through our AI systems solely for the purpose of generating virtual try-on results
• Temporarily transmit your photos to our secure servers for AI processing

This license terminates immediately upon processing. Your photos are not stored, retained, or used for any other purpose beyond generating your requested try-on result.

6.2 AI-Generated Results

• AI-generated try-on results are provided for personal, non-commercial use unless otherwise specified
• Results are generated by artificial intelligence and are artistic interpretations; they do not constitute professional advice regarding fashion, beauty, or personal appearance
• You may save, share, and use generated results for personal purposes
• You may not use generated results to deceive, defraud, or misrepresent identity

6.3 Content Restrictions

You agree not to upload or provide any content that:

• Contains nudity, sexually explicit material, or pornographic content
• Depicts violence, abuse, or harm toward any person or animal
• Contains images of minors (under 18) without the consent of a parent or legal guardian
• Infringes on the intellectual property rights, privacy, or other rights of any third party
• Is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable
• Depicts any person without their knowledge or consent in a manner that could cause harm or embarrassment
• Is intended to generate deepfakes or misleading representations of real individuals

We reserve the right to refuse processing of any content that violates these restrictions, without prior notice or explanation.

7. Intellectual Property

The App, including but not limited to its design, graphics, user interface, code, algorithms, AI models, logos, trademarks, and all related content, is the exclusive property of CinderSpire Studio and is protected by copyright, trademark, and other intellectual property laws.

• You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms
• You may not copy, modify, distribute, reverse-engineer, decompile, or disassemble any part of the App
• The "Lookify" name, logo, and all related marks are trademarks of CinderSpire Studio
• Style templates, categories, and curated content within the App are proprietary and may not be reproduced

8. Prohibited Uses

You agree not to use the App to:

1. Violate any applicable local, state, national, or international law or regulation
2. Generate content that infringes on any third party's intellectual property or privacy rights
3. Create deepfakes, misleading imagery, or content designed to deceive others about any person's identity or appearance
4. Harass, bully, intimidate, or harm any individual
5. Distribute malware, viruses, or any other harmful software
6. Attempt to circumvent the credit system, subscription restrictions, or rate limiting mechanisms
7. Use automated systems, bots, scrapers, or scripts to access or interact with the App
8. Reverse-engineer, decompile, or attempt to extract the source code or AI models used by the App
9. Resell, redistribute, or commercially exploit the Service or any content generated through it without prior written consent
10. Interfere with or disrupt the integrity or performance of the Service or its underlying infrastructure
11. Impersonate any person or entity, or misrepresent your affiliation with any person or entity
12. Use the Service to process images of individuals without their consent

Violation of these terms may result in immediate termination of your access to the App, forfeiture of any remaining credits, and potential legal action.

9. Disclaimer of Warranties

THE APP AND ALL RELATED SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, CINDERSPIRE STUDIO DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
• WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE
• WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR QUALITY OF AI-GENERATED RESULTS
• WARRANTIES THAT ANY DEFECTS IN THE APP WILL BE CORRECTED

AI-generated try-on results are approximations and may not accurately represent how a hairstyle, clothing item, or makeup style would appear in reality. Results should not be relied upon for making purchasing decisions or as professional styling advice.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CINDERSPIRE STUDIO, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Any loss of profits, data, use, goodwill, or other intangible losses
• Damages resulting from unauthorized access to or alteration of your transmissions or data
• Damages resulting from any content or conduct of any third party on the Service
• Any damages arising from your reliance on AI-generated results

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY EXCEED THE GREATER OF (A) THE AMOUNT YOU HAVE PAID TO US IN THE SIX (6) MONTHS PRECEDING THE CLAIM, OR (B) FIFTY US DOLLARS ($50.00).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.

11. Indemnification

You agree to indemnify, defend, and hold harmless CinderSpire Studio and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use of the App or Service
• Your violation of these Terms
• Your violation of any third-party rights, including intellectual property, privacy, or publicity rights
• Any content you upload to or generate through the App
• Your violation of any applicable law or regulation

12. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including but not limited to a breach of these Terms.

Upon termination:

• Your license to use the App is immediately revoked
• Any remaining credits in your account are forfeited and non-refundable
• Active subscriptions should be cancelled through the applicable app store to prevent further charges
• Provisions of these Terms that by their nature should survive termination shall survive, including ownership, warranty disclaimers, indemnification, and limitations of liability

You may terminate your agreement with us at any time by deleting the App and cancelling any active subscriptions through your app store.

13. End User License Agreement (EULA)

This section serves as the End User License Agreement required by Apple for apps distributed through the Apple App Store, and supplements the Apple Standard EULA.

13.1 License Grant

Subject to your compliance with these Terms, CinderSpire Studio grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on devices that you own or control, strictly in accordance with these Terms and the applicable app store terms.

13.2 License Restrictions

You shall not:

• License, sublicense, sell, resell, transfer, assign, distribute, or otherwise commercially exploit or make available to any third party the App or its content
• Modify, create derivative works of, disassemble, reverse-compile, or reverse-engineer any part of the App
• Access the App to build a competitive product or service, or copy any features, functions, or graphics of the App
• Remove, alter, or obscure any proprietary notices (including copyright and trademark notices) on the App

13.3 Third-Party Terms

The App may include third-party software subject to separate license terms. Your use of such software is governed by the applicable third-party license terms in addition to these Terms.

13.4 Apple-Specific Terms

If you access the App through the Apple App Store, the following additional terms apply:

• These Terms are between you and CinderSpire Studio only, not with Apple. CinderSpire Studio is solely responsible for the App and its content.
• Apple has no obligation to provide any maintenance or support services for the App.
• In the event of any failure of the App to conform to an applicable warranty, you may notify Apple and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation.
• Apple is not responsible for addressing any claims by you or any third party relating to the App or your use of it, including (a) product liability claims, (b) any claim that the App fails to conform to legal or regulatory requirements, and (c) claims arising under consumer protection or similar legislation.
• In the event of any third-party claim that the App infringes a third party's intellectual property rights, CinderSpire Studio, not Apple, shall be solely responsible for the investigation, defense, settlement, and discharge of any such claim.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
• You represent and warrant that (a) you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and (b) you are not listed on any U.S. Government list of prohibited or restricted parties.

14. Governing Law & Dispute Resolution

14.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law provisions.

14.2 Dispute Resolution

Any dispute arising out of or relating to these Terms or the Service shall be resolved as follows:

1. Informal Resolution: Before initiating formal proceedings, you agree to contact us at [email protected] and attempt to resolve the dispute informally within 30 days.
2. Jurisdiction: If informal resolution is unsuccessful, any legal proceedings shall be brought exclusively in the courts of Istanbul, Turkey.

14.3 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, and the remaining provisions shall continue in full force and effect.

14.4 Waiver

The failure of CinderSpire Studio to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of CinderSpire Studio.

14.5 Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and CinderSpire Studio regarding your use of the App and supersede all prior agreements, understandings, and communications.

15. Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes, we will:

• Update the "Last Updated" date at the top of this page
• Post the revised Terms at this URL
• For material changes, provide notice through the App (e.g., in-app notification or pop-up) at least 14 days before the changes take effect

Your continued use of the App after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the App and cancel any active subscriptions.
